General Terms and Conditions of Sale

The general terms and conditions of contract set out in this document govern the sale of Products carried out by the Seller through access to the Website by either the Consumer Customer or the Professional Customer and form an integral part of any purchase proposal submitted by the Customer and accepted by the Seller.
Where these general terms and conditions refer to the Customer without any further specification, they shall be deemed applicable to both Consumer Customers and Professional Customers.


Definitions

Seller
ErreBi SAS, with registered office at Via Spangaro 23, 30037 – Peseggia di Scorzè (Venice), Italy, VAT no. 02550470278, registered with the REA under no. VE-223468, is the company selling the Products through access to the Website and submission of an Order by the Customer.

Consumer Customer
Any adult natural person who accesses the Website, completes and submits an order form for one or more Products, and makes the purchase for purposes unrelated to any commercial, business, or professional activity carried out.

Professional Customer
Any natural or legal person who accesses the Website, completes and submits an order form for one or more Products, and makes the purchase for purposes related to their commercial, business, or professional activity, indicating their VAT number in the order form.

Products
All products included in the Seller’s electronic catalogue and viewable at www.errebi.it at the time the Order is submitted, to be delivered within Italian territory, excluding deliveries to P.O. boxes or similar and/or to entities providing domiciliation services.

Website
The website www.errebi.it.

Order
The purchase proposal for one or more Products submitted by the Customer by accessing the Website, completing the order form in all its parts, and sending it to the Seller through the electronic commerce service provided by the Seller.


Conclusion of the Sales Contract – Express Acceptance of the Order

Submission of an Order implies that the Customer has read and accepted all the information provided by the system during completion of the order form.
The contract between the Seller and the Customer is concluded exclusively upon the Seller’s sending of an email containing express acceptance, even partial, of the Order submitted by the Customer.

Acceptance is communicated by the Seller via email sent to the email address provided in the order form, generally no later than two business days after receipt of the Order.
The acceptance email will indicate the date and time of receipt of the Order and a “Customer Order Number”, which must be used in any subsequent communication with the Seller.

If an Order is not accepted, the Seller undertakes to notify the Customer promptly, generally no later than seven business days from receipt. In such case, any amount reserved on the Customer’s payment method will be released accordingly.

The Seller reserves the right, at its sole discretion, to accept, refuse, or partially accept one or more Orders submitted by the Customer.


Product Characteristics

The Customer may purchase only the Products described and illustrated in the product information sheets available on the Website at the time the Order is submitted.
The Seller reserves the right to modify its electronic catalogue at any time, including the range of Products and related information on their properties and characteristics, in order to align them with information provided by manufacturers, without prior notice.

Images accompanying product descriptions may not be perfectly representative of the Products’ characteristics and may differ in color, size, or accessories shown, due to technical and resolution characteristics of the Customer’s device.
Accordingly, the Seller shall not be held liable for any inaccuracies in graphical representations, which are provided for illustrative purposes only.


Product Prices

All prices displayed on the Website for each Product are retail prices and therefore include VAT.
The Seller reserves the right to change prices at any time without prior notice. Any changes to prices or offers shall take effect from the date and time they are published on the Website.

Product prices do not include delivery costs.


Delivery Costs

Delivery costs for the Product(s) included in an Order are calculated only at the time the Customer completes the Order and are indicated separately from the Product price, based on the selected carrier, delivery location, and the type and quantity of Products ordered.

Delivery costs refer exclusively to curbside delivery and do not include floor delivery, as well as any additional charges related to storage of Products that could not be delivered due to the Customer’s absence at the delivery address.


Invoicing

At the time the Products are handed over to the carrier, the Seller issues a valid fiscal document indicating the details provided by the Customer in the Order.
The amounts shown on the invoice include the price of the Product(s) and delivery costs, inclusive of all duties, taxes, and charges required by law.

The Customer releases the Seller from any liability arising from incorrect fiscal documents due to errors in the data provided by the Customer, who remains solely responsible for entering accurate information.
No changes to the invoice will be possible after its issuance.


Payment Methods

The Seller accepts the following payment methods:

  • Credit cards operating on Visa or Mastercard circuits and prepaid credit cards (e.g., PostePay).

At no time during the purchase process is the Seller able to access the Customer’s credit card details, as such information is transmitted directly, via encrypted secure connection, to the banking institution managing the electronic payment.
Therefore, the Seller does not store Customers’ credit card data and cannot be held liable for fraudulent or unauthorized use of credit cards by third parties.


Customer Obligations Upon Delivery

Upon delivery of the Products by the carrier, the Customer must verify that:

  • the number of packages corresponds exactly to what is indicated on the invoice;

  • the packaging is intact, undamaged, not wet, and not altered in any way.

Any discrepancies or damage must be immediately reported to the carrier, and the Customer must refuse delivery and promptly notify the Seller by email at ecommerce@errebi.it, attaching photographic evidence if available.


Product Inspection and Defect Notification

Even if the packaging is intact, the Products must be inspected by the Customer within four days of receipt.
Any damage or hidden defects must be promptly reported in writing to the Seller by registered letter with return receipt or by email to ecommerce@errebi.it, and to the carrier whose details are indicated in the accompanying documentation.


Complaints

Any complaint relating to the sales contract must be submitted in writing by the Customer and addressed to the Seller’s registered office at Via Spangaro 23, 30037 – Peseggia di Scorzè (Venice), Italy.


Applicable Law and Jurisdiction

The sales contract between the Customer and the Seller is deemed concluded in Italy and governed by Italian law.
For contracts concluded with Consumer Customers, the competent court shall be that of the Customer’s place of residence.
For contracts concluded with Professional Customers, jurisdiction shall lie exclusively with the court identified pursuant to Articles 18 and 19 of the Italian Code of Civil Procedure.


Amendments to the General Terms and Conditions

The Seller may amend these terms and conditions at any time without prior notice.
Any amendments shall take effect from the date the updated terms are published on the Website.
